3. 면제 대상
만 14세 미만인 사람
대한민국 출생 또는 만 14세 미만에 입국하여 만 14세 이후 해외에서 6개월 이상 연속하여 체류하지 않은 사람
사증 발급 시 해외 범죄경력증명서를 제출하고 사증 발급일로부터 3개월 이내 국내에서 체류자격변경을 신청하는 사람
범죄경력증명서 발급대상 국가기준에 따라 발급 제한 연령이거나, 발급을 위한 거주요건을 충족하지 못하여 발급이 어려운 사람

관련 서류의 제출하는 절차에 있어서 그동안 몃가지 문제점이 있었는데 이번에 벼녁오딘 절차가 있어 변경네용을 정리해 봅니다.

외국국적동포 업무 관련 건의사항 등을 반영하여 해외 범죄경력증명 서류 관련 세부기준 등 업무처리기준을 일부 변경하여 다음과 같이 시행함을 알려드립니다.
□ 해외 범죄경력증명서류 유효기간 변경
❍ 사증발급·체류자격 변경허가·체류기간 연장허가 신청일로부터 6개월 이내 발급된 서류일 것
(기존 3개월 → 6개월)
□ 해외 범죄경력증명서류 제출 세부기준 명확화
❍ (사증발급·체류자격변경)
국적국 및 신청일로부터 10년 이내 1년 이상 계속*하여 체류한 제3국의 범죄경력증명서류 제출
❍ (체류기간연장)
체류허가 기간 중 해외에서 6개월 이상 계속*하여 체류한 사람은 6개월 이상 계속*하여 체류한 국가의 범죄경력증명서류 제출
* 출국일로부터 1개월 이내 동일 국가로 재입국하면 계속하여 체류한 것으로 간주
(예시)
① 한국 → A국(6개월) → B국(6개월) → 한국 : 제출 대상(A, B국)

※ 단, 체류허가 기간 중 해외에서 6개월 이상 계속하여 체류한 사실이 있는 경우는 제출해야 하며, ‘19. 9. 2. ∼ ‘22. 9. 1. 기간에는 6개월 이상 해외에 체류하여 제출대상이 되더라도 1회는 제출 면제하고 2회 연장 시부터는 6개월 이상 계속하여 해외 체류한 사실이 있으면 원칙대로 제출 대상이 됨
□ 귀화용 종합평가 합격자를 재외동포(F-4) 자격부여 대상으로 추가
❍ 사회통합프로그램을 이수하거나 사전평가를 치르지 않았으나, 귀화신청을 하고 귀화용 종합평가에 합격하여 5단계를 배정받은 외국국적동포는 재외동포(F-4) 신청 가능
참고] 사회통합프로그램 교육 및 평가 참여자에 대한 재외동포(F-4) 자격부여
– 사회통합프로그램 4단계 이상 이수한 사람
– 사회통합프로그램 사전평가에서 5단계를 배정받은 사람
– 사회통합프로그램을 이수하거나 사전평가를 치르지 않았으나 귀화허가 신청을 하고 귀화용 종합평가에 합격하여 5단계를 배정받은 사람
